Outbound Dialing & User Responsibility Acknowledgment

1. Platform-only role

You acknowledge DialProng supplies tools. You—not DialProng—are the sole “seller,” “telemarketer,” “caller,” or “initiator” under applicable law for campaigns you configure.

2. Non-compliant configurations are possible — you assume the risk

Outbound dialing platforms can be configured in ways that may be non-compliant with telephone consumer protection, do-not-call, recording-consent, and related laws if misused. You assume full responsibility for every option you enable, including dial mode (progressive / predictive / prong), caller ID / local presence, AMD, voicemail drops, recording, messaging, scripts, dispositions, AI prompts, and contact selection.

3. Your compliance duties

You alone are responsible for: prior express (written) consent where required; federal/state DNC and internal opt-outs; calling-time and time-zone rules; caller ID / local-presence compliance; call-recording consent laws; truthful scripts; industry rules; and retention of suppression and consent records.

4. Waiver of claims against DialProng

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU WAIVE AND RELEASE ANY CLAIM AGAINST DialProng ARISING FROM YOUR CALLING, MESSAGING, RECORDING, OR AI USE—INCLUDING CONSUMER, REGULATORY, OR CLASS CLAIMS—WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR STATUTE. You will not name DialProng as a co-defendant for your campaigns except where non-waivable law requires otherwise, and you remain primarily liable and must indemnify DialProng.

Nothing in the Platform is legal advice. Any compliance assist features do not guarantee compliance.
