- Billing Authorization & Chargeback PolicyCustomer authorizes recurring charges, recognizes the DIALPRONG statement descriptor, and agrees wrongful chargebacks trigger liquidated damages (greater of $5,000 or 2×) plus attorney’s fees, collections, and lawful credit reporting.
- Terms of ServicePlatform access terms — AS IS warranty disclaimer, liability cap, indemnification, and waiver of class / collective actions to the maximum extent permitted by law.
- Outbound Dialing & User ResponsibilityDialProng is a tools platform only. Customer is solely responsible for TCPA, DNC, consent, recording laws, and all campaign choices — and waives claims against DialProng for Customer’s calling practices.
- Data Usage & ProcessingCustomer is controller of contact/call data; DialProng processes it to deliver billing, dialing, AI, fraud/chargeback defense, and support.
Clickwrap acceptance
I am authorized to bind the business named in this account. I have read and agree to DialProng’s Terms of Service, Billing Authorization & Chargeback Policy, Outbound Dialing / User Responsibility Acknowledgment, and Data Usage terms (see /legal). I authorize recurring subscription and usage charges to appear as DIALPRONG (or DIALPRONG*SUB). I understand abusive chargebacks after authorized use are a breach subject to liquidated damages of the greater of $5,000 or 2× the disputed amount, plus attorney’s fees, costs, and interest, and that DialProng may pursue collections and lawful credit reporting. I acknowledge DialProng is a platform only and I am solely responsible for TCPA/DNC and all calling compliance.
